Terms of Service
Last updated: 22 August 2026
These terms apply when you buy or use a FoundSignal Visibility Report. FoundSignal is a trading name of [LEGAL NAME] (ABN 97 493 694 613), [BUSINESS ADDRESS]. By buying a report you agree to these terms.
1. What the FoundSignal Visibility Report is
The FoundSignal Visibility Report is an informational visibility assessment. We look at how easy your business is to find and understand across Google search results, AI assistants and a range of public websites and platforms, and we give you a report describing what we observed and what we suggest you consider doing about it.
It is general information and suggestions based on our own observations. It is not marketing, legal, financial or other professional advice, and it is not a guarantee about how your business will perform.
2. One-off purchase
Each report is a single, one-off purchase. There is no subscription, no ongoing monitoring and no automatic renewal. If you want another report later, you buy another report.
3. Point-in-time testing
A report is a snapshot. It records what we observed at the time we ran the tests. Search results, AI answers, business listings and third-party information change constantly, and results can differ between people, devices, accounts and locations. Re-running the same tests later may produce different results even if nothing about your business has changed.
4. Google and search results
We run searches through third-party search data services using Australian settings. Search engines personalise and change results, and the data we receive may not match exactly what you see in your own browser. We do not control search engines and we are not affiliated with them.
5. AI testing and variability
We ask AI assistants a set of questions a customer might realistically ask, without naming your business, and record whether your business is mentioned. AI systems are probabilistic: the same question can produce different answers at different times, for different users, or after a model is updated. AI answers can also be incomplete or wrong. Our results describe what those assistants returned to us during our tests only.
6. Third-party platforms and information
Parts of the report depend on third-party services and publicly available information, including website crawling, search data, business directories, social platforms and AI providers. Those services can be unavailable, rate-limited, incomplete or inaccurate, and can block automated access. Where we could not check something, we say so rather than guessing. We are not responsible for the accuracy of third-party information.
7. The FoundSignal Score
The FoundSignal Score is our own measure, calculated from the observations recorded in your report using our published methodology. It is not an industry standard, it is not endorsed by Google or any AI provider, and it does not predict revenue, leads or rankings. We may improve the scoring methodology over time; where a score version matters for comparison we record it with the report.
8. Action Plan and recommendations
The Action Plan lists actions derived from what we observed in your report, ranked by our own prioritisation logic. They are suggestions to help you decide what to look at first. You are responsible for deciding whether an action is suitable for your business and for carrying it out. We do not guarantee that following any recommendation will change your visibility or your results.
9. Repeat reports and comparisons
If you buy a repeat report and link it to an earlier one, we re-run comparable tests and show the differences. A change shown in a comparison is a difference in what we observed between two points in time. It does not prove that a particular action you took caused the change, and other factors outside anyone's control may be responsible.
10. Your responsibilities
- Give us a website address for a business you own or are authorised to act for.
- Give us a working email address so we can contact you about your order.
- Make your own decisions about whether to act on anything in the report.
- Don't use FoundSignal to analyse a website in breach of anyone's rights or the law.
11. Payment
The price of a report is shown at checkout in Australian dollars and is payable in full before we begin. We use Stripe to process payments. We do not receive or store your full card details. Your purchase is complete when Stripe confirms the payment to us.
12. Promotional reports
We sometimes issue promotional codes that reduce the price, including to zero. A promotional report is supplied on the same terms as a paid report except that, where nothing was paid, there is nothing to refund. Promotional codes may be withdrawn or limited at any time and cannot be exchanged for cash.
13. Report delivery
After payment is confirmed we start work and give you a report link. Most reports are ready within an hour. If a check takes longer, we keep working on it. Your report appears at that link as it completes, so you can close the page and come back to it.
Keep your report link. It is how you get back to your report. Anyone you give the link to may be able to see the report.
14. Failed or partial reports
Occasionally a report cannot be completed — for example if your website cannot be reached or analysed, or if a service we rely on is unavailable. If that happens we will try again where we reasonably can, tell you plainly, and either re-run the report or refund you in line with our Refund Policy.
15. Refunds
Our Refund Policy forms part of these terms and explains when you can get a refund, a re-run or another remedy. Nothing in it limits your rights under the Australian Consumer Law.
16. Intellectual property
We own the FoundSignal name, the website, the report format, the scoring methodology and the underlying software. When you buy a report, you get a licence to use that report inside your own business, including sharing it with your own staff or advisers. Please don't resell it, publish it as your own product, or use it to build a competing service.
Information about your own business remains yours.
17. Acceptable use
Don't attempt to disrupt, overload, reverse engineer or gain unauthorised access to FoundSignal, and don't use it to run bulk automated checks or to analyse websites you have no legitimate connection to. We may decline or cancel an order, with a refund where appropriate, if we reasonably believe it breaches these terms.
18. Service availability
We aim to keep FoundSignal available, but it depends on third-party hosting, data and AI services. We do not promise uninterrupted or error-free service, and we may need to suspend it for maintenance or for reasons beyond our control.
19. Limitation of liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have that cannot lawfully be excluded, restricted or modified, including any applicable rights under the Australian Consumer Law.
Subject to that, and to the fullest extent permitted by law: we are not liable for loss of profits, loss of revenue, loss of business opportunity, loss of goodwill, loss of data, or any indirect or consequential loss, arising out of or in connection with a report or your use of FoundSignal; and our total liability in connection with a particular report is limited, at our option, to re-supplying that report or refunding the amount you paid for it.
We are also not liable for the acts, omissions, outages or decisions of search engines, AI providers, directories, social platforms or other third parties, or for what you choose to do based on a report.
20. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If a service we supply fails to meet a consumer guarantee, you are entitled to have the problem fixed, and where the failure is major you may be entitled to cancel and receive a refund, and to compensation for any other reasonably foreseeable loss or damage. Nothing in these terms takes those rights away.
21. Privacy
How we handle your information is set out in our Privacy Policy.
22. Changes to these terms
We may update these terms from time to time. The version that applies to your report is the version you agreed to at checkout, which we record with your order. Changes do not apply retrospectively to a report you have already bought.
23. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.
24. Support and contact
For anything at all — questions, problems, refunds or privacy requests — use our contact form. We'll do our best to respond promptly.
